الملخص

ملخص: سنّ المشرع الجزائري ترسانة قانونية تتعلق بتنظيم النشاط العمراني، مانحا لسلطات الضبط الإداري على المستوى المحلي وسائل الضبط الإداري العمراني من أجل ضبط وإحكام السيطرة في مجال البناء التعمير وحفاظا على النظام العام العمراني، وقد ألزم المشرع الجزائري رئيس المجلس الشعبي البلدي مراقبة كل بناء يقع على إقليم بلديته، واتخاذ الاحتياطات الضرورية والتدابير الوقائية لضمان سلامة الأشخاص والممتلكات لاسيما إذا تعلق الأمر بالبنايات الآيلة للانهيار التي تهدد الأمن البيئي. تتمحور إشكالية الدراسة حول ما إذا كانت الصلاحيات المخولة لرئيس المجلس الشعبي البلدي بهدم البنايات الآيلة للانهيار من شأنها إقرار النظام العام داخل الدولة وإحقاق الأمن البيئي؟ وقد خلصت الدراسة إلى وجوب تعزيز وتفعيل الرقابة على البنايات الآيلة للانهيار التي تشكل خطرا على الأرواح والممتلكات، بإجراء تحقيقات خبرة دورية على البنايات القديمة للحفاظ على الأمن العام. الكلمات المفتاحية: النظام العام العمراني؛ الضبط الإداري العمراني؛ البنايات الآيلة للانهيار؛ الأمن البيئي. Abstract: The Algerian legislator enacted a legal arsenal related to the regulation of urban activity, by granting to the administrative control authorities at the local level the means of urban administrative control in order to control the field of construction and reconstruction as well as to preserve the urban public order. The legislator has obligated the head of the Municipal People’s Council to control every building located on the territory of his municipality, and to take the necessary precautions and preventive measures for ensuring the safety of people and property, especially if it comes from collapsing buildings that threaten environmental security. But are the powers granted to the President of the Municipal People's Assembly to demolish buildings that are in danger of collapse, are sufficient to impose public order within the state and to embody environmental security? We concluded that it is necessary to activate the oversight of buildings that are in danger of collapsing, by conducting periodic expert investigations on the old buildings, in order to maintain public security.
