أثر قيام المسؤولية التقصيرية للمنتج في التشريع الجزائري ووسائل دفعها القانونية

الملخص
ملخص: يهدف هذا البحث إلى دراسة المسؤولية التقصيرية للمنتج في التشريع الجزائري، مع التركيز على الأثر القانوني الذي تترتب عليه في حال وقوع ضرر ناتج عن منتج معيب، كما يتناول البحث الوسائل القانونية التي يمكن للمنتج الاستناد إليها لدفع المسؤولية التقصيرية، مثل إثبات سلامة المنتج، أو نفي علاقة السببية، أو التمسك بالقوة القاهرة أو خطأ الغير. بالإضافة إلى ذلك، يسعى البحث إلى تحليل مدى فعالية تطبيق هذه الوسائل في الواقع القضائي الجزائري. وقد أسفرت الدراسة عن مجموعة من النتائج التي أكدت على الدور الهام للمسؤولية التقصيرية للمنتج في حماية حقوق المستهلكين وتعزيز العدالة الاجتماعية،حيث تكرس هذه المسؤولية حق المتضرر في التعويض، وتساهم في الوقاية من الأضرار من خلال الضغط القانوني على المنتجين لضمان سلامة وجودة منتجاتهم، كما أن الأثر القانوني الأبرز لهذه المسؤولية يكمن في إنشاء قواعد قانونية موضوعية لحماية المستهلك خارج نطاق العلاقة التعاقدية. This research aims to examine the tortious liability of the producer under Algerian legislation, with a focus on the legal consequences that arise in the event of damage caused by a defective product. The study also addresses the legal defenses available to the producer to avoid tortious liability, such as proving the safety of the product, disputing the causal link, invoking force majeure, or attributing the fault to a third party. Additionally, the research seeks to analyze the effectiveness of these defenses in the Algerian judicial practice. the study has led to a set of findings emphasizing the significant role of tortious liability for the producer in protecting consumer rights and promoting social justice. This liability not only enshrines the right of the harmed party to compensation but also contributes to preventing harm by applying legal pressure on producers to ensure the safety and quality of their products. The most notable legal effect of this liability is the establishment of objective legal standards for consumer protection beyond the scope of contractual relationships
