انعكاسات التكنولوجيا على الجريمة والمنظومة القضائية

الملخص
إن التقدم التكنولوجي في العصر الحديث وإن كان يفتح آفاقا أمام تقدم البشرية،إلا أنه بالمقابل يحمل في طياته مخاطر تهدد حقوق وحريات الأفراد وأمن واستقرار الدول، من خلال انعكاساته السلبية على الجريمة والقانون، فالأولى عرفت تطورا وانتشارا واسعا استغلت فيها التقنيات الموجودة ، أما الثاني فعرف قفزة نوعية في سياسته المستجدة. وعليه جاءت هذه الورقة البحثية لمعالجة إشكالية جوهرية مفادها انعكاسات التكنولوجيا على عالم الجريمة والمنظومة القضائية تناولناها ضمن محورين، محور أول جاء لتحديد مفهوم الجريمة التقليدية والمستحدثة منها وعددنا أهم ما يميز هذه الأخيرة ويعكس خطورتها،أما المحور الثاني فبين أثر التكنولوجيا على أجهزة القضاء بحيث تم ذلك بقراءة الآليات الجديدة المعتمدة في الإجراءات التحقيق والحكم كالتقاضي الإلكتروني،المحاكمة الإلكترونية، لنختم هذه الدراسة بنتيجة هامة مفادها أن التكنولوجيات الحديثة ساهمت في التوسيع من نطاق تطبيق الجرائم الإلكترونية وطورت التقليدية منها كما عملت على تبني التكنولوجية القانونية جديدة تعزز الوصول للعدالة. Although technological progress in the modern era opens horizons for the progress of humanity, it, in return, carries with it risks that threaten the rights and freedoms of individuals and the security and stability of states, through its negative repercussions on crime and the law. The former has witnessed widespread development and spread in which existing technologies have been exploited, while the latter has known A qualitative leap in his new policy. Accordingly, this research paper came to address a fundamental problem, namely the repercussions of technology on the world of crime and the judicial system. We addressed it within two axes. The first axis, we defined the concept of traditional and new crimes, and enumerated the most important features that distinguish the latter and reflect their seriousness. As for the second axis, it showed the impact of technology on the judiciary. This was done by reading the new mechanisms adopted in investigation and judgment procedures, such as electronic litigation and electronic trial. To conclude this study with an important result that modern technologies have contributed to expanding the scope of application of electronic crimes and developed traditional ones, as well as I worked to adopt legal technology that enhances access to justice.
