Regulatory Framework Of Start-ups In Algeria: A North African Comparative Perspective

Authors : Berbache Sami .

Abstract

This study traces the evolution of Algeria's startup laws from 2001 to 2025. It aims to uncover how deeply embedded institutional legacies have created a regulatory framework that stands apart from its regional counterparts. Three innovations stand out from the legal analysis: (1) a hybrid qualification system balancing objective criteria with discretionary innovation assessment, (2) time-limited tax exemptions creating accountability mechanisms within support structures, and (3) state-centric financing reflecting Algeria’s institutional legacies. The regulatory design in Algeria appears to offer broader qualification criteria and greater flexibility for business model innovations than Tunisia’s technology-focused approach, while maintaining stronger domestic ownership requirements than Egypt’s open model. Yet despite progress, critical gaps remain—notably in intellectual property enforcement, regulatory clarity for emerging technologies, and private capital mobilization. The findings contribute to understanding how formal legal rules can overcome institutional path dependencies in resource-dependent economies, which creates new trajectories for innovation-led development.
