الملخص
ملخص: تناول هذا البحث "الأسلحة ذاتية التشغيل من منظور القانون الدولي الإنساني بين شرعية الاستخدام وحتمية الامتثال". يهدف الى القاء الضوء على موضوع الأسلحة ذاتية التشغيل كونها أحدث وسيلة حرب، وذلك ببيان مفهوم الأسلحة ذاتية التشغيل، خصائصها وأنواعها، ومدى امتثالها لمبادئ القانون الدولي الإنساني، بالاعتماد على المنهج الوصفي والتحليلي. قد خلص البحث الى نتائج مهمة، ان الأسلحة ذاتية التشغيل لا تمتثل بشكل كلي لمبادي القانون الدولي الإنساني، فضلا عن ذلك، فهي أسلحة لا تستوجب الحظر او التقييد لذاتها، بل لأنها تتمتع بخاصية جوهرية هي الاستقلالية. لم تتمكن تقنيات الذكاء الاصطناعي الراهنة من جعل الاسلحة ذاتية التشغيل كليا تتصف بالأمان والموثوقية في بيئات محددة سواء من ناحية استخدامها او تطويرها. الأمر الذي يشكل تحديا جوهريا على مستقبل القانون الدولي الإنساني. Abstract: The Paper deals with "Autonomous Weapons from the Perspective of International Humanitarian Law: between the Legitimacy of Use and the Inevitability of Compliance". It aims to highlight on the topic of autonomous weapons as a newly mean of warfare, by explaining the concept of autonomous weapons, their characteristics and types, and the extent of their compliance with the principles of international humanitarian law relying on the descriptive and analytical approach. The research has concluded that autonomous weapons do not fully comply with the principles of international humanitarian law. Moreover, they are weapons that do not require a ban or restriction on their own, but rather because they have an essential feature, which is autonomy. Current Artificial Intelligence (AI) technologies have not been able to make fully autonomous weapons safe and reliable in specific environments, whether in terms of their use or development. This poses a fundamental challenge to the future of international humanitarian law.
