القواعد الأصولية المستنبطة من التعليلات الفقهية في كتاب البيان والتحصيل لابن رشد الجد رحمه الله

الملخص
ترمي هذه الدراسة إلى بيان مدى حضور التعليل الفقهي في تأصيل الفتاوى والأحكام، وذلك من خلال بيان مقصود التعليل الفقهي والكشف عن قيمته المنهجية في الاستنباط والفرق بينه وبين التعليل الأصولي وأثره في صياغة القواعد الأصولية وإبراز ملامح المنهج الاستنباطي في الفقه المالكي من خلال كتاب "البيان والتحصيل" لابن رشد الجد، وتم ذلك وفق محورين رئيسيين الأول تناولت فيه التعليلات الفقهية في كتاب البيان والتحصيل من خلال تقديم نبدة عن الكتاب ومؤلفه ومفهوم التعليل الفقهي والفرق بين التعليل الفقهي والتعليل الأصولي والمحور الثاني تناولت فيه أثر التعليل الفقهي في بناء القواعد الأصولية من خلال تعريف القاعدة الأصولية وعلاقتها بالتعليل الفقهي واستخراج قواعد أصولية من تعليلات ابن رشد في كتابه البيان والتحصيل. Article Summary: This study aims to demonstrate the extent to which Islamic jurisprudential reasoning is present in the foundations of fatwas and rulings. This is achieved by clarifying the purpose of Islamic jurisprudential reasoning, revealing its methodological value in deduction, and the difference between it and fundamental justification. It also explores its impact on formulating fundamental principles. It highlights the features of the deductive approach in Maliki jurisprudence, using the book "Al-Bayan wa'l-Tahsil" (The Clarification and Attainment) by Ibn Rushd al-Jadd. This study is structured around two main axes. The first addresses the jurisprudential justifications in Al-Bayan wa'l-Tahsil by providing an overview of the book and its author, the concept of jurisprudential justifications, and the difference between the jurisprudential justifications and fundamental justification. The second axis addresses the impact of jurisprudential reasoning on constructing fundamental principles by defining the fundamental principles and its relationship to jurisprudential justification, and extracting fundamental principles from Ibn Rushd's reasoning in Al-Bayan wa'l-Tahsil.
