Criminalization Of Sorcery And Witchcraft Under Penal Code No. 24-06

Abstract
This study aims to shed light on sorcery and witchcraft, practices as old as human civilizations but relatively new in terms of legal criminalization. These crimes are widespread and have devastating effects on humanity. Islamic law has a clear stance on such practices, prohibiting them. However, from a legal perspective, the Algerian legislature criminalized them under Law No. 24-06, which defines their elements and the penalties prescribed for them. This article will examine the effectiveness of legal texts in curbing the spread of these crimes and achieving deterrence. تهدف هذه الدراسة إلى تسليط الضوء على أعمال السحر والشعوذة التي تعتبر قديمة قدم الحضارات الإنسانية لكنها من الناحية القانونية مستحدثة التجريم، حيث تعتبر هذه الجريمة من الممارسات المنتشرة والتي لها آثار مدمرة على الإنسانية، لذا كان موقف الشريعة الإسلامية واضح بشأن هذه الأعمال وهو التحريم، لكن من الناحية القانونية فإن المشرع الجزائري قام بتجريمها بموجب القانون رقم 24-06 الذي حدد أركانها والعقوبات المقررة لها، لذا ستعنى هذه المقالة بالبحث في مدى فاعلية النصوص القانونية في الحد من إنتشار هذه الجريمة وتحقيق الردع فيها.
