خصوصية نظام الثنائية البرلمانية في ظل النظام الدستوري الجزائري

الملخص
لقد عالجت هذه الدراسة موضوع خصوصية نظام الثنائية البرلمانية في ظل النظام الدستوري الجزائري، ذلك ان هذا النظام يختص بتنظيم السلطة التشريعية من خلال جعلها مكونة من غرفتين بدل غرفة واحدة تمارسان مظاهر السلطة التشريعية من سن للقوانين ورقابة للعمل الحكومي، كما أن تبني النظام السياسي الجزائري لنظام الإزدواجية التشريعية كان نتيجة للظروف السياسية التي عاشتها الجزائر، لهذا كان لزاما على المشرع الدستوري إضافة مجلس الأمة كغرفة ثانية للبرلمان إلى جانب المجلس الشعبي الوطني بعد العديل الدستوري لسنة 1996 والذي يرتكز على أسس قانونية وأخرى سياسية، وقد تم طرح الإشكالية الآتية: فيما تكمن خصوصية نظام الثنائية البرلمانية في ظل النظام الدستوري الجزائري؟ من خلال تقسيم الموضوع إلى مبحثين، حيث تم التطرق في المبحث الأول: مضمون نظام الثنائية البرلمانية، أما المبحث الثاني فتم التطرق فيه إلى مبررات أو دواعي إعتماد نظام الثنائية البرلمانية في النظام الدستوري الجزائري. Abstract : This study addressed the specificity of the parliamentary duality system under the Algerian constitutional system, as this system is concerned with organizing the legislative authority by making it composed of two chambers instead of one chamber that exercise the manifestations of legislative authority, such as enacting laws and monitoring government work. The adoption of the Algerian political system of the legislative duality system was a result of the political circumstances experienced by Algeria. Therefore, it was necessary for the constitutional legislator to add the Council of the Nation as a second chamber of parliament alongside the National People's Assembly after the constitutional amendment of 1996, which is based on legal and political foundations. The following problem was raised: What is the specificity of the parliamentary duality system under the Algerian constitutional system? By dividing the subject into two sections, where the first section addressed: the content of the parliamentary duality system, while the second section addressed the justifications or reasons for adopting the parliamentary duality system in the Algerian constitutional system.
