أثر صفة الأصل الشرعي في أحكام جرائم العنف في التشريع الجزائري

الملخص
القرابة الشرعية بين الأصول والفروع هي رابطة دموية مقدسة تسمو على كل العلاقات الإنسانية، وإن حمايتها من مختلف أشكال الاعتداءات المادية والمعنوية لتعد من أعظم المقاصد الشرعية والأحكام القانونية، وهذا كله للحفاظ على المقومات الأخلاقية للأسرة الجزائرية، وتحقيق الأمن الأسري والمجتمعي، وفي سبيل ذلك لجأ المشرع الجزائري إلى مراعاة صفة الأصل الشرعي في أحكام التجريم والعقاب خصوصا في جرائم العنف، حيث سلك منهج التشديد في العقاب متى كان الأصل الشرعي مجنيا عليه، وزاوج بين التشديد والتخفيف متى كان جانيا وذلك لأسباب وحالات خاصة، وهذا ما يدفعنا إلى طرح التساؤل حول مدى مراعاة صفة الأصل الشرعي في أحكام جرائم العنف في التشريع الجزائري. Legal kinship is a sacred blood tie that transcends all other human relationships, which makes protecting it from various forms of physical and moral harm, one of the most important objectives of both Islamic law and legal provisions for the sake of preserving the moral fundamentals of Algerian families and ensuring domestic and societal security. To this end, the Algerian legislator has taken into account the status of legal origin in determining criminal liability and punishment, particularly in cases of violence crimes; harsher punishments are set when the legal ascendant is victim and a combination of harsh punishments and mitigate penalties when he is perpetrator for certain specific reasons and circumstances, this raises the problem of the extent to which Algerian legislation takes into account the status of legal origin in adjudicating cases of violence crimes.
