مبدأ حرية الاستثمار ما بين الإطلاق و التقييد (في ظلّ قانون الاستثمار 22-18)

الملخص
يقصد بمبدأ حرية الاستثمار فسح المجال و توسيع الحقل الاقتصادي للاستثمار فيه من قبل القطاع الخاص، في مقابل تراجع لتدخل الدولة في هذا المجال، و هذا كنتيجة للعجز الاقتصادي التي عانت منه الجزائر، و الذي فرّض عليه التخلي عن الاتجاه الاشتراكي والاقتناع بضرورة تبني نظام اقتصاد السوق. فكان لزاماً عليها تكييف منظومتها التشريعية وفقا لقواعد هذا النظام، من خلال الانسحاب التدريجي للدولة من الحياة الاقتصادية و فتح المجال أمام للقطاع الخاص، بالمبادرة في الحياة الاقتصادية من خلال عدة مبادئ: المعاملة العادلة و المنصفة للمستثمرين، حرية المنافسة، المبادرة...الخ و من بين تلك المبادئ، نجد مبدأ حرية الاستثمار، الذي يعتبر من أهم هذه المبادئ التي يقوم عليها اقتصاد السوق، بل يعدّ دعامة و ركيزة أساسية لهذا النظام، كما يعدّ عنصراً مساهماً في بناء بيئة استثمارية مشجّعة و جاذبة للاستثمار الأجنبي، بل يعتبرُ الأصلُ الذي تنبثق منه كل الضمانات التي تدور في رحى نظام الاستثمار عموماً. Abstract: The principle of freedom of investment means opening up and expanding the economic field for investment by the private sector, in contrast to the decline in state intervention in this field, and this is as a result of the economic deficit that Algeria suffered from, which forced it to abandon the socialist trend and become convinced of the necessity of adopting a market economy system. It was therefore necessary for it to adapt its legislative system in accordance with the rules of this system, through the gradual withdrawal of the state from economic life and opening the way for the private sector, to take the initiative in economic life through several principles: fair and equitable treatment of investors, freedom of competition, initiative... etc. Among these principles, we find the principle of freedom of investment, which is considered one of the most important principles on which the market economy is based, and is even a pillar and a basic foundation for this system, and is also an element contributing to building an encouraging and attractive investment environment for foreign investment, and is even considered the origin from which all the guarantees that revolve around the investment system in general emerge
