Abstract Freedom of opinion and expression is considered one of the fundamental and important human rights, one that significantly impacts other rights and freedoms. The existence of this right in a country, and the guarantee of its enjoyment and protection therein, is a hallmark of a democratic and developed society. Given the paramount importance of this right, as it contributes to strengthening and supporting the protection and preservation of other rights and freedoms, the international legal system has regulated its exercise and surrounded it with protection and care. This is confirmed by the provisions of all international and regional documents concerned with human rights and freedoms, most notably the Universal Declaration of Human Rights of 1948 and the International Covenant on Civil and Political Rights of 1966, which enshrine it in their articles and texts and work to establish it. Despite the guarantees it has received, the scope of this right is not absolute. Rather, it is governed by controls and limits that regulate how it is exercised and the areas of its application in specific cases, given the problems and challenges that arise from this on the one hand, and other considerations such as avoiding infringement on the rights and freedoms of others and maintaining public order on the other hand. Thus, international law seeks to achieve a balance between granting and protecting freedom of expression on the one hand, and placing legitimate legal restrictions on the other hand, in a way that ensures the protection of individual rights and the stability of society without compromising this freedom and its essence.
