State's Obligation To Compensate For Bodily Harm In The Absence Of A Responsible Party

Authors : Zouba Samira .

Abstract

Given the rise in accidents inherent to life in society, regardless of the origin of the harm suffered by the victim, its effects will be felt in the same way because it affects bodily integrity. The legislator was obliged to come to the aid of these victims—in the absence of a responsible party—by prescribing specific compensation schemes that comply with particular imperatives. This is, in fact, a socialization of risks, involving the State's assumption of certain so-called social risks based on the solidarity at the foundation of any social group.
