Abstract: The Islamic Presence in the Policy of the Founders of Jewish and Christian Endowments in Ottoman Jerusalem The study aimed to reveal a phenomenon that was not addressed by studies that dealt with the subject of endowments in Arab cities during different times in general and Jerusalem in particular. This phenomenon is represented by an Islamic presence in the establishment of Christian and Jewish endowments in Ottoman Jerusalem. This presence came in two forms: the first, is through the presence of Islamic charitable organizations on the list of beneficiaries of the revenues of non-Muslim endowments, both hereditary and charitable. The second form is represented by the influence of the provisions of Islamic jurisprudence on the conditions of the donor and the way he manages his endowments. The study attempted to shed light on this phenomenon through analysis, criticism and comparison, and to find explanations for it. The study is based on addressing this issue primarily on non-Islamic endowment documents in Ottoman Jerusalem during the nineteenth century and preserved in the records of the Ottoman Jerusalem Court. By searching through these records, a random sample was selected representing dozens of non-Islamic endowment contracts during the study period, and subjected to study and analysis. On the other hand, the study was based on the provisions of endowments in Islamic jurisprudence, especially the provisions of non-Islamic endowments, to find jurisprudential explanations for this phenomenon. The study concluded that the Jewish and Christian endowments in Ottoman Jerusalem stipulated the inclusion of Islamic charitable organizations among the beneficiaries of the revenues of their endowments in response to the provisions of Islamic jurisprudence, and not based on their own desires or in harmony with their coexistence with the Jerusalemite community. This is what I call the influence of the third party in the non-Islamic endowment in Ottoman Jerusalem. Keywords: Waqf, Jerusalem, dhimmis, Islamic jurisprudence.
