حق العامل في عطلة أو العمل بالتوقيت الجزئي لإنشاء مؤسسة في ظل قانون رقم 22- 16

الملخص
أقر المشرع للعامل حق في عطلة أو العمل بالتوقيت الجزئي لإنشاء مؤسسة في ظل قانون رقم 22-16 المتمم للقانون رقم 90-11 المتعلق بعلاقات العمل، ولاستفادة العامل من هذا الحق وجب توفر شروط قانونية في العامل كأن لا تقل أقدميته عن ثلاث سنوات. يتضمن طلب العامل بيانات إلزامية كتحديد مدة العطلة أو فترة العمل.و يكون رد المستخدم كتابيا على طلب العامل في صورة الموافقة أو التأجيل أو عدم الموافقة. يترتب عن استفادة العامل من عطلة أو العمل بالتوقيت الجزئي لإنشاء مؤسسة تعليق علاقة العمل وما يترتب عنها من توقيف الأجر و أقدمية العامل،وأيضا يستفيد هذا الأخير من حقوق أساسية .و في حالة عجز العامل عن إنشاء مؤسسة يتم إدماجه في منصب عمله الأصلي، أو إعادة تشغيله بالتوقيت الكامل.و تنتهي علاقة العمل بمجرد انجاز العامل مؤسسته، أو في حالة عدم تقديم طلب إعادة الإدماج في الآجال القانونية. الكلمات المفتاحية: العمل بالتوقيت الجزئي؛عطلة غير مدفوعة الأجر؛عقد العمل لمدة غير محدودة؛عطلة لإنشاء مؤسسة؛ الأقدمية. Abstract: The legislator has granted the worker the right to vacation or part-time work in order to start a business under Law No. 22-16 supplementing Law No. 90-11 on labor relations. In order for the employee to benefit from this right, legal requirements must be met, such as the employee's seniority, which must not be less than three years. The worker's request includes mandatory data, such as the specification of the duration of the vacation or the working period. The user's response to the worker's request must be written in the form of approval, postponement or non-approval. The fact that the worker is on vacation or working part-time to establish a business suspends the employment relationship and thus the consequent suspension of the worker's salary and seniority. The latter also benefits from fundamental rights. And in case the worker is not able to establish a business, he/she is reinstated in his/her original job, or restarted on a full-time basis. The employment relationship ends as soon as the worker completes his or her business, or if the request for reinstatement is not submitted within the legal deadline. keywords: part-time work; unpaid time off ;a contract of employment for an indefinite period ;vacation to start a business; seniority.
