Many fatwas have been issued by Muslim jurists regarding the ruling on residing in non-Muslim lands. One of the most famous is the fatwa issued by Imam Al-Wansharisi, entitled "Asna al-Matajar fi Hukm Min Ghalab 'ala Watanihi al-Nasara wa Lam Yahajir," which was issued after the fall of Al-Andalus and the continued presence of Muslims under Spanish rule, which forced them to convert to Christianity. The fatwa prohibited staying in Al-Andalus. However, there are opinions that argue that this fatwa does not take into account the reality and neglects the higher objectives of Shari'ah, such as the principle of ease (maqasid al-shari'ah). Therefore, this article aims to analyze the fatwa, present its evidence, evaluate its adherence to the higher objectives of Shari'ah, and address the criticisms it has faced. It will also examine the circumstances under which it was issued, its position among other contemporary fatwas, and discuss its impact on vulnerable Muslim minorities in our time.
