أقسام المقاصد الشّرعيّة عند ابن راشد القفصي المالكي (736هـ)

الملخص
تطرّقت في هذا البحث إلى ترجمة موجزة لشخصية ابن راشد القفصي، ثمّ عرّفت المقاصد وذكرت أقسامها، كما أنّي فصّلت في الكلام على مقاصد العبادات والمعاملات عند ابن راشد وغيره من العلماء. ثمّ بيّنت جريان تعليل الأحكام الشّرعية في العبادات والمعاملات إلا أنّه الغالب في باب المعاملات، كما ذكرت أقسام الأحكام بحسب ما شرعت لتحقيقه من المصالح وأنّ هذا تقسيمٌ مبتكرٌ من ابن راشد. وقد حاز ابن راشد قَصَب السّبْقِ في بيان أنّ مقاصد العبادات والعادات كانت في الوجود قبل العبادة أو المعاملة التي شُرعت من أجل تحقيق ذلك المقصد. Abstract: In this research, I provided a brief biography of Ibn Rashid al-Qafsi, then defined the purposes and mentioned their categories. I also elaborated on the purposes of acts of worship and transactions according to Ibn Rashid and other scholars. Then I explained the existence of justifications for legal rulings in acts of worship and transactions, noting that it predominantly applies to transactions. Furthermore, I mentioned the categories of rulings according to the benefits they aim to achieve, mentioning that this innovative classification was initially introduced by Ibn Rashid. I concluded that Ibn Rashid achieved a pioneering position in emphasizing the purposes of acts of worship and customs before the act of worship or transaction, which was legislated to achieve that purpose. Dans cette recherche, j'ai abordé une brève biographie d'Ibn Rachid Al-Qafsi, puis j'ai défini les objectifs de la Sharia et mentionné leurs catégories. J'ai également détaillé les objectifs des actes d'adoration et des transactions selon Ibn Rachid et d'autres érudits. J'ai expliqué l'application de la justification des règles juridiques dans les actes d'adoration et les transactions, bien que cela soit plus prédominant dans le domaine des transactions. J'ai également mentionné les catégories des règles selon les intérêts qu'elles sont censées réaliser, soulignant que cette classification est une innovation d'Ibn Rachid. Ibn Rachid a été un pionnier en démontrant que les objectifs des actes d'adoration et des coutumes existaient avant l'acte d'adoration ou la transaction légiférée pour réaliser cet objectif
