مُكمّلات المقاصد الشّرعيّة مفهومُها وأقسامُها وقواعدُها

الملخص
هذه الدّراسة تهدف إلى الكشف عن حقيقة مُكمّلات المقاصد الشّرعيّة وموقعها بين جملة مقاصد التّشريع الكليّة، وعن أبرز المعاني الكليّة الضّابطة لهذه المكمّلات والموجّهة لما ينبغي تقديمُه منها في مقامات التّعارض، واعتمدت في سبيل تحقيق ذلك منهجَ الاستقراء الأغلبيّ في تجميع المادّة العلميّة، والمنهجَ التّحليليّ في الإفادة من ذلك من أجل إبراز أهمّ المعاني المتعلّقة بمُكمّلات المقاصد ومُتعلَّقاتها، وخلصت إلى نتائج أهمها: ـ أنّ مُكمّلات المقاصد الشّرعيّة تُعتبر من مُلحقات المقاصد الأصليّة، وهي مُختلفةٌ عن المقاصد التّبعيّة. وأنّ كون مقصدٍ من المقاصد أصليّاً أو مُكمّلاً أمرٌ نسبيٌّ، وقد يكون المقصدُ الواحدُ أصلاً من جهة، ومُكمِّلاً من جهة أخرى. Supplements of Sharia objectives Its concept, sections and rules summary This study aims to reveal the truth about the complements of the legal objectives and their position among the overall objectives of legislation, and the most prominent overall meanings that govern these complements and direct what should be presented from them in situations of conflict. In order to achieve this, it adopted the majority induction method in compiling scientific material, and the analytical method in making use of it. In order to highlight the most important meanings related to the complementary purposes and their related matters ,It concluded with results, the most important of which are: - That the complements of the legal objectives are considered supplements to the original objectives, and they are different from the secondary objectives. Whether one of the purposes is original or complementary is a relative matter, and a single purpose may be original on the one hand, and complementary on the other hand.
