افتراض سوء النية في مرحلة إبرام العقد الالكتروني

الملخص
لا شك أن الاهتمام على نحو خاص بمبدأ سوء النية يمثل تطوراً قانونياً في محاولة الوقوف عند أحكام هذا المبدأ، وتبيان أثره في العقود لأهميته التي لا تنكر ارتباطه الوثيق بالواقع العملي خاصة في مرحلة التكوين للعقد، خاصة في ظل تطور التعاملات المالية واعتماد التبادل الالكتروني، هذا ما يكشف بجلاء ان اخضاع العقد الالكتروني لمبادئ قانونية لا تتماشى مع أليات العالم الافتراضي، والدعوة إلى تبني منظومة تتلاءم ومستوى التعامل الالكتروني، هذا ما يحرص عليه المشرع في البحث عن سبل تحقيق الأمن التعاقدي والعدالة العقدية، من خلال محاربة سوء النية بكل الوسائل القانونية حماية للعقد من كل ما يهدد استقراره وأمنه من أنواع الطرق غير المشروعة التي تشكل جوهر سوء النية، لذلك جاءت الدراسة من أجل البحث حول مدى افتراض هذا المبدأ في مرحلة تكوين العقد الالكتروني. There is no doubt that paying special attention to the principle of bad faith represents a legal development in the attempt to understand the provisions of this principle and to clarify its impact on contracts, given its undeniable importance and its close connection to practical realities, especially during the formation stage of a contract. This is particularly relevant in light of the evolution of financial transactions and the reliance on electronic exchanges. This clearly reveals that subjecting electronic contracts to legal principles that do not align with the mechanisms of the virtual world calls for the adoption of a system that is compatible with the level of electronic transactions. This is what legislators strive to achieve by seeking ways to ensure contractual security and fairness in contracts, through combating bad faith by all legal means to protect contracts from anything that may threaten their stability and security, especially the various illegal methods that constitute the essence of bad faith. Therefore, this study aims to explore the extent to which this principle is presumed during the formation of electronic contracts.
