Invoice Transactions As A Mechanism For Market Protection: Between Effectiveness And Obligation

Authors : Lemouchia Samia .

Abstract

Transparency is considered one of the most crucial factors in addressing potential market irregularities. The legislator has explicitly enshrined it as a principle and regulatory measure for all commercial practices conducted between economic operators and consumers. This principle is codified in various legal texts that stipulate important obligations ensuring transparency, particularly in the post-transaction and contract completion phase. These obligations are primarily manifested through the mandatory invoicing requirement for any sale or service provision. Within this framework, the legislator has established civil, penal, and administrative sanctions for economic operators who fail to fulfill their duty of issuing invoices in any special system of sales or services, and providing them upon request. This underscores the significance and necessity of this obligation as a legal mechanism that guarantees market protection while simultaneously extending to consumer protection. The subject matter of this research paper is therefore of considerable importance, warranting renewed examination in light of the economic transformations that Algeria has experienced. It explores the efficacy of invoicing obligations in promoting market transparency and safeguarding consumer interests within the evolving economic landscape.
