الضوابط القانونية لاختصاص المحكمة الجنائية الدولية للفصل في الجرائم الدولية

الملخص
إن موضوع اختصاصات المحكمة الجنائية الدولية من المواضيع المهمة التي تتعلق بهذه المحكمة، كون أن البحث في هذا الموضوع يهدف إلى تبيان مدى اختصاص المحكمة شخصيا وموضوعيا وزمانيا ومكانيا بالنظر في الجرائم الدولية، بالإضافة إلى معرفة الضوابط التي تحكم المحكمة في ممارسة هاته الاختصاصات، وهكذا كله في إطار نظام روما الأساسي الذي يوضح في مواد صريحة هاته الضوابط والاختصاصات المتعلقة بالمحكمة الجنائية الدولية.وتتمحور إشكالية هذا الموضوع حول متى تكون المحكمة الجنائية الدولية مختصة بالنظر في الجرائم الدولية؟، ولمعالجة هاته الإشكالية تم التطرق الى مبحثين، ففي المبحث الأول تم دراسة الضوابط المسبقة لممارسة المحكمة الجنائية الدولية لاختصاصها، ويتعلق المبحث الثاني باختصاصات المحكمة الجنائية الدولية. ABSTRACT The subject of the jurisdiction of the International Criminal Court is one of the important topics related to this court, The fact that research on this subject aims to clarify the extent of the jurisdiction of the Court personally, objectively, temporally and spatially to consider international crimes, In addition to knowing the controls that govern the court's exercise of these jurisdictions, This is all within the framework of the Rome Statute, which clarifies in explicit articles these controls and competencies related to the International Criminal Court , iction of the International . Criminal Court of the International Criminal Court the problem of this topic revolves around: When is the International Criminal Court competent to look into international crimes? To address this problem, two sections were addressed. In the first section, the prior controls for the International Criminal Court’s exercise of its jurisdiction . were studied, and the second section relates to the jurisdiction of the International Criminal Court
