الملخص
ملخص يعتبر موضوع التبليغ عن الجريمة و الشهادة من مواضيع الساعة التي شغلت تفكير المختصين في القانون و علماء الاجتماع معا لما تكتسيه من أهمية بالغة ليس من حيث المساهمة في اكتشاف خيوط الجريمة و تحديد أطراف الجريمة من الجاني ، الضحية و تحديد مسرح الجريمة فحسب و إنما تتعدها محاولة إشراك أفراد المجتمع للمساهمة الفعالة في الحد من الجريمة و مساعدة الفاعلين في الضبط الاجتماعي، من خلال عمليات التبليغ عن الجريمة و الشهادة ، لكنها حسب اعتقادنا لم تنال حقها من التناول السوسيولوجي و هو ما تسعى إليه الدراسات السوسيولوجية و المختصين في علم الاجتماع الجريمة بالأخص إلى جانب القانونيين الذين يسعون إلى ضبط متغير الشهادة و التبليغ و دعمه بالقوانين اللازمة للتشجيع على التبليغ عن الجريمة و حماية الشهود ، ما جعل المختصين في الاجتماع موضوع التبليغ عن الجريمة ضرورة اجتماعية تساهم في استقرار المجتمع و تماسكه و هي جزء لا يتجزأ من قيم المجتمع الثابتة . في حين أن الشريعة الإسلامية أولت أهمية قصوى إلى موضوع أداء الشهادة و اعتبرتها أمانة و واجبة على الفرد أدائها و هي فريضة على من شهد جريمة ما إحقاقا للحق و أداء لواجب في حين يعتبر من تخلى او تقاعس عنها آثم من وجهة نظر الشريعة الإسلامية ، و هو ما سنفصله لاحقا في هذه الدراسة السوسيولوجية . Summary The topic of crime reporting and testimony is one of the topics of the day that occupied the thinking of law professionals and sociologists together because it is of great importance not in terms of contributing to the discovery of the threads of crime and identifying the perpetrator's parties to the crime. the victim, and only the crime scene, but also the reluctance to try to involve members of society in order to contribute effectively to reducing crime and helping actors in social control, Through the reporting of crime and testimony, but it is our belief that she was not entitled to sociological treatment, which is what sociological studies and sociologists in particular seek, as well as legal professionals who seek to control the variable testimony, report and uphold the laws necessary to encourage crime reporting and witness protection, What made the specialists of the meeting the subject of reporting the crime a social necessity contributing to the stability and cohesion of society and is an integral part of society's inalienable values. While the Islamic Shariah attached the utmost importance to the subject of the performance of the certificate and considered it honest and obligatory for the individual to perform it. It is imposed on anyone who witnessed a crime for the realization of the right and the performance of a duty, while the person who abandoned or failed to do so is deemed sinful from the point of view of the Islamic Shariah
