Legal Protection Of Children Of Unknown Parentage According To The International Perspective

Abstract
Children constitute an integral component of society, with the fundamental right to life from which numerous protective rights emanate, preparing them to fulfill their societal duties. Throughout history, children have been referred to by various terms, including minor, juvenile, young boy, and ward. Notably, children of unknown parentage face deprivation of a vital aspect of human existence- identity and lineage- thus impeding the establishment of their personality and their full entitlement to civil, social, and cultural rights. This scenario starkly contrasts with children whose lineage is known, prompting an investigation into whether children of unknown parentage receive protection under statutory laws and international conventions. يعتبر الطفل جزء أساسيا في تكوين المجتمع، و حقه في هذه الحياة حقا أساسيا تتفرغ منه عدة حقوق تحميه إلى أن يستطيع التعرف عى واجباته إتجاه مجتمعه، و سمي الطفل بالعديد من المسميات الحدث، القاصر ، الصبي الصغير و الموصي عليه، و بما أن الطفل مجهول النسب قد حرم من أهم عنصر في الحياة، الذي يحدد أصله ، و تاريخ أجداده ألا وهو النسب ففيه تستقيم شخصية الطفل و تعطى له جميع الحقوق المدنية و السياسية والإقتصادية و الاجتماعية و الثقافية ، هذا بالنسبة للطفل معلوم النسب، فهل الطفل مجهول النسب محمي وفقا للتشريعات الوضعية و الإتفاقيــــات الدولية.
