Article 98 Of The Rome Statute: U.s. Immunity Agreements In The Framework Of International Law

Abstract

Abstract: The establishment of the International Criminal Court (ICC) aims to effectively combat impunity and uphold justice and the rule of law. For the ICC to function optimally, it needs broad adherence to its statutes, especially since it lacks universal jurisdiction. The United States has used Article 98 of the Rome Statute—which respects national sovereignty and principles of the UN Charter like free consent and good faith—to avoid legal accountability. This inquiry examines the legitimacy of the U.S. using Article 98 to negotiate exemption agreements, exploring their impact on international justice and the ICC's mission, and assessing their consistency with the Rome Statute's goals. ملخص تعد المحكمة الجنائية الدولية واحدة من أعظم إنجازات القرن العشرين. فهي سلاح قوي ضد الإفلات من العقاب من وجهة نظر سيادة القانون والعدالة. ومع ذلك، لكي تكون المحكمة فعالة، يجب أن يكون مجال اختصاصها على أوسع نطاق ممكن من خلال انضمام أكبر عدد ممكن من الدول لنظامها الأساسي في ظل غياب الولاية القضائية العالمية. واحتراما لسيادة الدول و حرية الإرادة وحسن النية وغيرها من المبادئ المقررة في ميثاق الأمم المتحدة تم وضع المادة 98 من اتفاقية روما، غير أن الولايات المتحدة الأمريكية استغلتها من أجل الإفلات من العقاب. يعالج المقال مدى شرعية الاتفاقيات التي أبرمتها الولايات الأمريكية مستندة على المادة 98 من نظام روما.
