الملخص

لقد أولى الدستور الحالي 2020 أهمية كبرى للمحكمة الدستورية ونظم ما يتعلق بها وفق منهجية تختلف عن تنظيمه للمؤسسات والسلطات الدستورية. ومن ملامح تلك المنهجية أنه نظمها من كل الجوانب وحدد اختصاصاتها وقراراتها والآثار المترتبة عن تلك القرارات بالتفصيل، ومنحها سلطة وضع النظام المحدد لقواعد عملها ضمانا لاستقلاليتها. ورغم ذلك لم تسلم تلك المنهجية من أوجه قصور وتناقضات مست بعض المواد أهمها: 190 و191 و142 و 198 و98، و94. The current constitution of 2020 has attached great importance to the Constitutional Court and regulated what is related to it according to a methodology that differs from its organization of constitutional institutions and authorities. One of the features of this methodology is that it organized it from all aspects and defined its competencies, decisions, and the implications of those decisions in detail, and gave it the authority to set the specific system for its work rules to ensure its independence. Despite this, this methodology was not spared from deficiencies and contradictions affecting some of the most important articles: 190, 191, 142, 198, 98, and 94.
