الملخص
ملخص: تتناول هذه الورقة البحثية دراسة التحول النوعي للوقف من صيغته التقليدية إلى "الصناديق الوقفية" كأحد أهم مؤسسات القطاع الثالث الحديثة والمبتكرة. حيث تستعرض الورقة المفهوم الشرعي والاقتصادي والقانوني لهذه الصناديق باعتبارها أوعية استثمارية تحول الأموال من الاستهلاك إلى الإنتاج، مبرزةً أثرها الفعّال في دفع عجلة التنمية من خلال دعم القطاعين العام والخاص، وتمويل مشاريع البنية التحتية والزراعة والتجارة، فضلاً عن دورها الاجتماعي الحيوي في مجالات التعليم والصحة ورعاية الأسرة والمعاقين. وتتخذ الدراسة من التجربة الكويتية نموذجاً تطبيقياً رائداً، موضحةً كيف نجحت الأمانة العامة للأوقاف في إدارة صناديق تخصصية حققت قفزة نوعية في الخدمات العامة، لتخلص المداخلة في ختامها إلى ضرورة تبني هذه النماذج المؤسسية في الدول العربية والإسلامية، ولاسيما الجزائر لتعزيز التنمية المستدامة ومحاربة مشكلات التضخم والبطالة، وتقليل الاعتماد الكلي على الإنفاق الحكومي. Abstract: This research paper examines the paradigmatic shift of the waqf (Islamic endowment) from its traditional form to "Waqf Funds" as a leading innovative institution within the contemporary third sector. The study elaborates on the Islamic jurisprudential shari economic, and legal conceptualizations of these funds as investment vehicles that channel capital from consumption into production, emphasizing their substantive impact on accelerating development through bolstering both public and private sectors، financing infrastructure، agricultural, and commercial ventures، alongside their crucial social function in education, healthcare, family welfare, and disability services. Drawing upon the Kuwaiti experience as an exemplary applied model, the paper illustrates how the General Secretariat of Awqaf successfully administered specialized funds, resulting in a qualitative leap in public service provision. The study concludes with advocating for the adoption of these institutional frameworks across Arab and Islamic nations, with particular emphasis on Algeria, as a strategic imperative to foster sustainable development, combat inflation and unemployment, and diminish aggregate reliance on government expenditure.
