الملخص
الأمن القانوني هو حالة توفر فيها النصوص القانونية الوضوح، الاستقرار، وسهولة الوصول، مما يتيح للأفراد والمستثمرين التصرف بثقة واطمئنان. وتكمن أهمية الأمن القانوني في مجال الاستثمار في تعزيز الثقة بين المستثمر والدولة، ويقلل من المخاطر القانونية، ويضمن استقرار القوانين وعدم تعديلها بشكل مفاجئ. ويمثل القانون 22-18 خطوة هامة في تطوير التشريعات الاستثمارية في الجزائر، حيث يهدف إلى تعزيز الأمن القانوني من خلال مبادئ المساواة والشفافية والثبات التشريعي. يوفر القانون ضمانات قانونية، مثل ضمان عدم رجعية القوانين وضمان حماية الحقوق المكتسبة للمستثمرين إضافة إلى حماية الملكية العقارية والفكرية، إضافة إلى ضمانات إجرائية تشمل تسهيل اللجوء إلى القضاء. Abstract Legal security is a condition in which legal texts provide clarity, stability, and accessibilility, enabling individuals and investors to act with confidence and assurance. The importance of legal security in the field of investment lies in its capacity to strengthen trust between the investor and the state, reduce legal risks, and ensure the stability of laws by preventing their sudden or arbitrary amendment. Investment Law22-18 represents a significant step in the development of investment legislation in Algeria, as it aims to enhance legal security through the principles of equality, transparency, and legislative stability. The Law provides substantive legal guarantees, including the guarantee of non-retroactivity of laws, the protection of investors' vested rights, and the safeguarding of both real property rights and intellectual property rights. In addition, it establishes procedural guarantees that encompass the facilitation of access to judicial remedies.
