Abstract: This study aims to analyze and evaluate the position of the of the United States of America (USA) toward the International Criminal Court (ICC) and its implications for the principle of non-impunity as a fundamental pillar of international criminal justice (ICJ). It focused on analyzing the dimensions of the American policy of rejecting the Court's jurisdiction, the legal and political measures adopted to shield U.S. nationals from international criminal prosecution, and the resulting challenges that have undermined the effectiveness of international accountability mechanisms, as well as the universality and credibility of international criminal justice. The study concludes that consolidating the principle of non-impunity depends not only on the continued development of the international legal framework but also on the existence of genuine collective political will and broader international cooperation, particularly among the major powers. Such cooperation is essential to strengthening international accountability, enhancing the effectiveness of international criminal justice, and combating international criminality.
