Legal Responsibility For Patent Infringement In The Contemporary Technological Environment

Abstract
The study examines legal liability for patent infringement in the modern technological environment, particularly in the context of digital technologies, artificial intelligence, and advanced manufacturing. Using analytical, comparative, and descriptive approaches, it explores the challenges of proving infringement, identifying responsible parties, and applying existing legal frameworks to digital and cross-border violations. The study concludes that traditional civil and criminal liability rules are insufficient to address the complexities of modern technological infringements. It therefore recommends updating legal frameworks, adopting more flexible legal mechanisms, and strengthening international cooperation to ensure effective patent protection in the digital age. الملخص:تتناول الدراسة المسؤولية القانونية عن الاعتداء على براءات الاختراع في البيئة التكنولوجية الحديثة، لا سيما في سياق التقنيات الرقمية والذكاء الاصطناعي والتصنيع المتقدم. ومن خلال توظيف المنهج التحليلي والمقارن والوصفي، تبحث الدراسة في التحديات المرتبطة بإثبات الاعتداء، وتحديد الأطراف المسؤولة عنه، وتطبيق الأطر القانونية القائمة على الانتهاكات الرقمية والعابرة للحدود. وتخلص الدراسة إلى أن قواعد المسؤولية المدنية والجزائية التقليدية لم تعد كافية لمعالجة تعقيدات الاعتداءات التكنولوجية الحديثة. ولذلك، توصي الدراسة بـ تحديث الأطر القانونية، واعتماد آليات قانونية أكثر مرونة، وتعزيز التعاون الدولي بما يضمن حماية فعالة لبراءات الاختراع في العصر الرقمي.
