تأثير البيئة الرقمية على حقوق الملكية الصناعية

الملخص
يشهد العالم في العقود الأخيرة تحولًا جدريًا بفعل الثورة الرقمية التي غيرت ملامح الاقتصاد والتجارة والصناعة على حد سواء، وقد أصبح الاعتماد على التكنولوجيا والبيئة الرقمية أمر لا غنى عنه في كافة القطاعات مما أفرز تحديات وفرصا جديدة في ميدان حقوق الملكية الصناعية. تهدف الدراسة إلى تحليل التغيرات التي فرضتها البيئة الرقمية على طبيعة وأشكال حقوق الملكية الصناعية، وخلصت الدراسة إلى أن البيئة الرقمية أظهرت ضعف فعالية بعض الآليات القانونية التقليدية في ردع انتهاكات الملكية الصناعية، خصوصًا فيما يتعلق بالتزوير الرقمي للعلامات التجارية. Abstract : In recent decades, the world has witnessed a profound transformation driven by the digital revolution, which has reshaped the landscape of the economy, commerce, and industry alike. The reliance on technology and the digital environment has become indispensable across all sectors, giving rise to both new challenges and opportunities in the field of industrial property rights. This study aims to analyze the changes imposed by the digital environment on the nature and forms of industrial property rights. It concludes that the digital environment has revealed the limited effectiveness of certain traditional legal mechanisms in deterring infringements of industrial property, particularly in relation to the digital counterfeiting of trademarks.
