Abstract: The review of the constitutionality of laws represents one of the most significant constitutional safeguards that reinforce the principle of the supremacy of the constitution and solidify the foundations of a state governed by the rule of law, without an oversight body ensuring the conformity of legislation with constitutional provisions and preventing the enactment of laws that violate them, achieving a just legal system becomes impossible. For this reason, most of the world's constitutions have placed great importance on this oversight, establishing independent bodies to undertake this pivotal role in regulating the legislative process. In Algeria, successive constitutions have affirmed the principle of constitutional review, initially entrusting this task to the "Constitutional Council", which was later transformed into the "Constitutional Court" under the 2020 constitutional amendment. Today, the Constitutional Court enjoys broad powers, extending beyond reviewing the constitutionality of laws after their enactment to preventive oversight—examining draft laws, particularly those related to rights and freedoms, before their adoption. This grants the Court an active role in shaping the legislative framework and establishes it as a cornerstone in ensuring the conformity and quality of legislation with constitutional principles
