Electronic Contract In Algerian Civil Law.

Authors : Berkane Fadhila .

Abstract

Abstract This research examines the electronic contract in Algerian civil law, providing its definition and clarifying its distinction from other contracts used in electronic transactions. The research reviews the principle of functional equivalence between electronic writing and traditional writing, as the legal basis for accepting electronic evidence. The research also clarifies the conditions that must be met in electronic writing and digital signatures, such as the ability to identify the contracting party and ensure the integrity of the contract's content. The research concludes that proving an electronic contract depends on fulfilling these conditions, making electronic writing and digital signatures essential tools for evidencing legal acts in the digital environment.
