Abstract

The extradition system is an aspect of international judicial cooperation and an effective mechanism to combat crime, as it helps ensure that criminals do not escape punishment, despite leaving the crime scene for the territory of another country. Its importance has increased in modern times, as most international agreements related to international judicial cooperation for combating serious crime include provisions on the extradition of criminals, in a way that respects the sovereignty of states among themselves. Algeria has ratified many bilateral and multilateral international agreements in this field, because domestic legislation alone is not sufficient to activate this system. Additionally, international criminal police systems are an effective mechanism in consolidating international cooperation aimed at arresting and extraditing criminals to the requesting state through the ratification of its charter. They contribute to the amendment of countries' extradition laws through studies and research conducted in this regard. إن نظام تسليم المجرمين من مظاهر التعاون القضائي الدولي ، وهو آلية ناجعة للتصدي للجريمة، إذ يساهم في ضمان عدم إفلات المجرمين من العقاب، رغم مغادرتهم لمكان ارتكاب الجريمة إلى إقليم دولة أخرى، ولقد ازدادت أهميته في العصر الحديث، لأن معظم الاتفاقيات الدولية المتعلقة بالتعاون القضائي الدولي لمكافحة الجريمة الخطيرة تتضمن أحكاما تتعلق بتسليم المجرمين، على النحو الذي يراعي احترام سيادة الدول فيما بينها، ولقد صادقت الجزائر على العديد من الاتفاقيات الدولية الثنائية و المتعددة الأطراف في هذا المجال، لأن التشريع الداخلي لا يكفي لوحده لتفعيل هذا النظام، كما أن الأنظمة الدولية للشرطة الجنائية آلية فعالة في توطيد التعاون الدولي الرامي إلى ضبط و قبض المجرمين و تسليمهم للدولة الطالبة من خلال مصادقة الدول على ميثاقها، وهي تساهم في تعديل قوانين الدول الخاصة بالتسليم من خلال الدراسات و البحوث التي تقوم بها في هذا الشأن.
