الملخص
الملخص: يعد نظام وقف تنفيذ العقوبة آلية قانونية حديثة في السياسة الجنائية الجزائرية، منظمة بموجب القانون: 25-14 (المواد 754-757 من قانون الإجراءات الجزائية). يتمثل في اختصاص قضائي بتعليق تنفيذ العقوبة الأصلية (السجنية أو المالية) لفترة اختبار، يخضع فيها المحكوم عليه للمراقبة. إذا لم تتم ادانته بجريمة جديدة خلالها، تسقط العقوبة بجميع آثارها. أما إذا أدين، فيلغى الوقف وتنفذ العقوبة الأولى. ويخضع منح الوقف لشروط موضوعية (كعدم سبق الحكم بعقوبة حبس) وإجرائية (كتوجيه إنذار للمحكوم عليه). ولا يمتد وقف التنفيذ للمصاريف أو التعويضات المدنية. يهدف النظام إلى تحقيق التوازن بين الردع والإصلاح، من خلال منح "فرصة ثانية" لإعادة الإدماج الاجتماعي. Abstract: The suspension of sentence enforcement is a modern legal mechanism within the Algerian penal policy, codified under Law No. 25-14 (Articles 754 to 757 of the Code of Criminal Procedure). It constitutes a judicial prerogative to suspend the enforcement of the principal penalty (imprisonment or financial) for a probationary period, during which the convicted person is placed under supervision. If no final conviction for a new offense is issued against them during this period, the penalty is extinguished with all its legal effects. Conversely, if a final conviction is issued, the suspension is revoked, and the initial penalty is enforced. The granting of this suspension is subject to substantive conditions (such as the absence of a prior prison sentence for a felony or misdemeanor) and procedural conditions (including the judge's obligation to issue an explicit warning to the convicted person regarding the legal consequences of any subsequent conviction). The suspension does not extend to court costs or civil compensation awards. The system aims to strike a balance between deterrence and rehabilitation by offering a "second chance" to facilitate the social reintegration of the offender.
