Abstract
The system of appearance based on prior admission of guilt is a modern legal procedure aimed at speeding up criminal case litigation. It allows the accused to confess before judicial authorities, enabling quicker dispute resolution and easing court burdens. This system includes safeguards to protect the accused’s rights, ensuring confessions are voluntary and accompanied by legal defense. Algeria incorporated this procedure in its new Code of Criminal Procedure No. 25/14, emphasizing justice and efficiency by reducing lengthy traditional processes that strain the judiciary. This approach balances swift resolution with legal protections for the accused يعد نظام المثول بناء على الاعتراف المسبق بالذنب إجراء قانونيا معاصرا يهدف إلى تسريع وتحسين مسار التقاضي في القضايا الجزائية. يتيح هذا النظام للمتهم فرصة الاعتراف بجريمته أمام الجهات القضائية المختصة، ما يسهل الفصل في النزاعات القضائية بسرعة ويقلل من الضغط على المحاكم. يعتمد هذا الإجراء على ضمانات قانونية مهمة تهدف إلى حماية حقوق المتهم، مثل التأكد من أن الاعتراف تم بحرية وبدون أي إكراه، فضلا عن وجود ممثل قانوني للدفاع. تبنى المشرع الجزائري هذا النظام ضمن قانون الإجراءات الجزائية الجديد رقم 25/14، تأكيدا على أهمية تحقيق العدالة وتقليل الإجراءات التقليدية المطولة التي تثقل كاهل القضاء.
