إعادة تصور النظام الانتخابي المحلي في الجزائر: نحو نموذج يحقق التوازن بين الشرعية الديمقراطية والكفاءة.

الملخص
تهدف هذه الدراسة إلى اقتراح نموذج انتخابي مزدوج يدمج بين مبدأ الشرعية الديمقراطية ومبدأ الكفاءة في تشكيل المجالس المحلية بالجزائر، حيث تنطلق من تشخيص واقع المجالس المنتخبة، التي تعاني من ضعف الأداء وقلة الفعالية بسبب اعتمادها الكلي على التمثيل الحزبي، مع إقصاء الكفاءات الإدارية والتقنية، وتقترح الدراسة صيغة مزدوجة لتشكيل المجالس المحلية، ثلثان بالانتخاب المباشر، وثلث بالتعيين من ذوي الكفاءات من طرف لجنة مستقلة، وفق معايير موضوعية وشفافة. يحقق النموذج المقترح التوازن بين التمثيل الشعبي وضمان جودة التسيير، ويحدد المشروع القانوني المرفق شروط تعيين الكفاءات، تركيبة اللجنة المستقلة، وآليات الرقابة، وخلصت الدراسة إلى أن هذا النموذج لا يتعارض مع الديمقراطية، بل يعززها من خلال إدماج الكفاءة في القرار المحلي، ويعد خطوة ضرورية لإصلاح منظومة التسيير المحلي وتحقيق التنمية. This study aims to propose a dual electoral model that integrates the principle of democratic legitimacy with that of competence in the formation of local councils in Algeria. It is grounded in a diagnosis of the current situation of elected councils, which suffer from weak performance and limited effectiveness due to their exclusive reliance on partisan representation, alongside the marginalization of administrative and technical expertise. In response, the study proposes a hybrid formula for composing local councils, whereby two-thirds of members are elected through direct suffrage, while one-third are appointed from among qualified experts by an independent committee, based on objective and transparent criteria. The proposed model seeks to strike a balance between popular representation and the quality of governance. The accompanying legal framework specifies the conditions for appointing experts, the composition of the independent committee, and the mechanisms of oversight. The study concludes that this model does not contradict democratic principles; rather, it enhances them by incorporating competence into local decision-making. It thus represents a necessary step toward reforming local governance and achieving sustainable development.
