تفرّدات المالكيّة في إلزاميّة شركة الأموال وأثرها في تنمية العمل المصرفيّ

الملخص
تهدف الدّراسة إلى إبراز مفردات مذهب المالكيّة في شركة الأموال في مسألة إلزاميّة العقد، وبيان أثر ذلك على تنمية العمل المصرفيّ، وقد تتبعت الخطوات المنهجيّة التّالية: المبحث الأوّل: ذكرت فيه التّعريف بمفردات البحث. المبحث الثّاني: دراسة فقهيّة لمسألة إلزامية عقد شركة الأموال بين المذهب المالكيّ ومذهب الجمهور. المبحث الثّالث: استقرار شركة الأموال بثوبها المعاصر ودور المذهب المالكيّ فيه. وقد خلصت الدّراسة إلى أنّ الأخذ بالمذهب المالكيّ في مسألة إلزاميّة عقد شركة الأموال سواء المشاركة المنتهية بالتّمليك أو المضاربة المشتركة يعطي الاطمئنان والأمان للعمليّة الاستثماريّة مما يؤدّي إلى إنجاح شركة الأموال ونمائها في المصارف الإسلاميّة This study aims to highlight the singularities of the Maliki school of thought in the company of funds in the matter of the obligation of the contract, and to clarify its impact on the development of banking work. The following methodological steps were followed: *First Part: Defining the research terms. *Second Part: A jurisprudential study of the issue of the obligation of the contract of the company of funds between the Maliki school of thought and the majority of schools of thought. *Third Part: The stability of the company of funds in its contemporary form and the role of the Maliki school of thought in it. The study concluded that adopting the Maliki school of thought in the matter of the obligation of the contract of the company of funds, whether the partnership ending in ownership or the joint speculation, gives reassurance and security to the investment process, which leads to the success and growth of the company of funds in Islamic banks
