الملخص
ملخص: تعتبر التّعقبات الفقهية أحد أبرز وسائل التّواصل العلمي بين الأجيال، حتَّى أصبحت أحد الدّراسات الأكاديمية التي انتشرت في هذا العصر؛ وذلك لما لها من أهمية في بيان اختيارات الفقهاء ومذاهبهم، وأهم المسائل التي تعقّبهم العلماء من بعدهم، وأراءهم التي خُولفوا فيها، وغير ذلك من العلوم المتعلقة بالفقه؛ حيث يمكن من خلالها استخلاص مناهج الفقهاء، والقواعد الفقهية والأصولية التي اتبعوها في كتبهم، فكانت هذه الدراسة الموسومة بـ"التّعقبات الفقهية للإمام علي بن أحمد العدوي على الشيخ يوسف الفيشي المالكي"، وإشكالية الدّراسة: إلى أي مدى اعتنى علماء المالكية بفقه الشّيخ الفيشي؟ وما هي أهم التّعقبات الفقهية للإمام العدوي على الشّيخ يوسف الفيشي؟ وما امتازت به هذه التّعقبات؟ Abstract: Jurisprudential studies are considered one of the most prominent means of scientific communication between generations, to the point that they have become one of the academic studies that have spread in this era. This is because of its importance in explaining the choices of jurists and their doctrines, the most important issues that scholars pursued after them, their opinions on which they differed, and other sciences related to jurisprudence. Through it, it is possible to extract the approaches of jurists, and the jurisprudential and fundamental rules that they followed in their books, so this study was labeled “The Jurisprudential Commentaries of Imam Ali bin Ahmad Al-Adawi on Sheikh Yusuf Al-Fayshi Al-Maliki”, and the problem of the study: To what extent did Maliki scholars care about the jurisprudence of Sheikh Yusuf Al-Fayshi? What are the most important jurisprudential implications of Imam Al-Adawi on Sheikh Yusuf Al-Fishi? What distinguished these tracks?
