Abstract
abstractThis research explores the radical shift in intellectual property protection mechanisms, moving from traditional restrictive methods to "Smart Protection" powered by Artificial Intelligence (AI) and Blockchain technology. Smart Protection aims to establish a digital environment capable of proactively detecting infringements and analyzing piracy patterns in real-time, positioning it as the new gold standard for safeguarding creators' rights in the age of generative content. The abstract discusses how these systems balance the freedom of information access with the preservation of financial and moral rights, emphasizing that AI has evolved from a mere tool into the primary "Digital Guardian" of modern content الملخص : يستعرض هذا البحث التحول الجذري في آليات حماية الملكية الفكرية، متنقلاً من الأساليب التقليدية القائمة على رد الفعل إلى نموذج "الحماية الذكية" المعزز بتقنيات الذكاء الاصطناعي وسلاسل الكتل (البلوكشين). تهدف "الحماية الذكية" إلى تأسيس نظام بيئي رقمي قادر على الكشف الاستباقي عن الانتهاكات وتحليل أنماط القرصنة لحظياً، مما يجعلها المعيار الذهبي الجديد لصون حقوق المبدعين في عصر المحتوى التوليدي. يناقش البحث كيفية موازنة هذه الأنظمة بين حرية تداول المعلومات والحفاظ على الحقوق المادية والمعنوية، مع التأكيد على أن الذكاء الاصطناعي قد تطور من مجرد أداة تقنية ليصبح "الحارس الرقمي" الأول للمحتوى الحديث. كما يشدد البحث على ضرورة تحديث الأطر التشريعية لتتواكب مع هذه المتغيرات التقنية، مقترحاً مقاربة شاملة لتأمين الابتكار في بيئة رقمية عابرة للحدود.
