Online Divorce And The Extent Of Legislative Recognition Under Family Law: An Analytical Study

Abstract
Abstract: This study analyzes online marriage, examining its concept, procedures, and underlying causes. It reviews Islamic jurisprudence, contemporary scholarly opinions, and Algerian statutory law. The research finds that Algerian Family Law does not explicitly regulate online marriage despite its prevalence, calling on lawmakers to clarify its legal recognition or regulation. Keywords: Online divorce; Challenges; Legal regulation. الملخص: تطرح هذه الدراسة الزواج الإلكتروني باعتباره ظاهرة قانونية واجتماعية متنامية تفرض نفسها على واقع العلاقات الأسرية المعاصرة. ومن خلال تحليل أبعاده الفقهية والتشريعية، تكشف عن تعقيداته وإشكالاته العملية في ظل التحول الرقمي المتسارع. وتفتح هذه الظاهرة باب التساؤل حول مدى جاهزية المنظومة القانونية لمواكبة هذا التطور، وما يترتب عنه من آثار تمس استقرار الأسرة وحماية الحقوق. الكلمات المفتاحية: الطلاق الإلكتروني؛ التحديات؛ التنظيم القانوني.
