This paper examines the right of divorced women to compensation for arbitrary divorce under Article 52 of the Algerian Family Code. It highlights the gap between the legal text and judicial practice, which lacks clear standards. Judges often rely on general Civil Code provisions to establish “arbitrariness,” using their discretion to interpret intent and determine compensation. The study finds that legislative ambiguity leads to inconsistent rulings, underscoring the need for objective criteria to ensure full redress of both material and moral harm.
