Provisions Of Compensation For Physical Harm In Islamic Jurisprudence And Positive Law: A Comparative Analytical Study

Authors : Ghendir Abdelbasset . Benelbar Ali .

Abstract

This paper presents a rigorous comparative and analytical study of the provisions of compensation for physical harm (bodily injury) in Islamic jurisprudence (Fiqh) and positive law. The research examines the foundational concepts of harm, its typologies and classifications, the bases of legal liability, and the conditions governing entitlement to compensation in both legal systems. The central research question addresses how Islamic jurisprudence and positive law conceptualize and regulate compensation for physical harm, and what the points of convergence and divergence are between the two systems. The study employs an analytical-deductive methodology combined with a comparative legal approach, drawing on primary sources including classical Islamic jurisprudential texts, contemporary legal codes, and peer-reviewed academic scholarship. The principal findings reveal that Islamic law established a comprehensive and holistic compensation framework grounded in the principles of justice (adl), deterrence (zajr), and reparation (jabr); while positive law, though differing in procedural mechanisms, converges with Islamic jurisprudence in its overarching objectives of protecting human dignity and rights. The research concludes with recommendations for integrating principles of Islamic jurisprudence into contemporary positive legislation to enhance justice and guarantee the rights of victims. This study contributes to the scholarly dialogue between Islamic law and comparative legal traditions.
