A Critical Research On The Dialectical Relationship Between The Environment And Human Rights

Authors : Haoues Sabah .

Abstract

Abstract: The question of the right to the environment was not only a matter of legal argument, but it was also at a time when this right was not so clearly defined. The precise nature of this right remains subject to doctrinal debate, notably concerning its ultimate holder (whether human-centric or ecocentric perspectives prevail) and its inherent nature (individual versus collective entitlement). This paper delves into these foundational controversies, analyzing how the relationship between human rights and the environment has evolved from perceived rivalry to acknowledged mutual enrichment.
