The Legal Dilemma Of The Human Right To Climate Asylum

Authors : Laidani Mohammed .

Abstract

There is a general consensus that natural disasters chief among them climate change are among the primary factors compelling individuals to flee their homelands in search of safety, whether through asylum, displacement, or migration, in order to escape life-threatening risks. Based on the fundamental right to a safe and secure environment, States are legally and morally obliged to receive such individuals, provide them with necessary protection and assistance, and ensure their enjoyment of fundamental rights. However, the notion of climate refugee continues to face significant legal and practical challenges that hinder its recognition within the international refugee protection framework. These challenges stem primarily from the absence of a universally accepted legal definition, the lack of political will on the part of many States to adopt this concept, and concerns over the potential legal and economic implications of formally recognising climate-induced displacement. Such obstacles significantly impede the development of a comprehensive legal framework for their protection.
