Modern Obligations As A Legal Safeguard For Consumer Protection

Authors : Khodja Hassina .

Abstract

The protection of consumers has emerged as a persistent legal imperative, particularly amid rapid transformations in the global marketplace. Consumer contracts, characterized by a structural asymmetry between the uninformed consumer and the professionally equipped supplier, underscore the necessity of regulatory intervention. Modern legal obligations—namely, the duties to inform, warn, and advise—serve to recalibrate this imbalance by imposing heightened disclosure and advisory responsibilities on professionals. These obligations transcend traditional liability doctrines, such as the warranty against hidden defects, by proactively safeguarding consumer consent. Legislators have thus recognized the insufficiency of classical principles and instituted tailored frameworks to ensure transparency, mitigate informational disparities, and reinforce contractual fairness.
