دور الوكالة الجزائرية في تسيير وتنظيم العقار الاقتصادي في ظل القانون 23/17

الملخص
تعد الوكالة الجزائرية لترقية الاستثمار من المؤسسات الفاعلة لتحقيق التنمية الاقتصادية من خلال اشرافها ومتابعتها لمختلف الاستثمارات في الوطن، وهو ما جعل المشرع يعيد النظر في الصلاحيات الموكلة لها من خلال سن قانون رقم 23/17. ولما كان العقار الحلقة الأساسية في الاستثمار قام المشرع بإنشاء هيئات مهمتها تنظيم عملية استغلال العقارات الموجهة للاستثمار من خلال تحديد كيفيات عملها وحصر صلاحيتها تماشيا مع التوجهات الاقتصادية الرامية الى تحسين استغلال هذا النوع من العقارات التي يعد من اهم انشغالات المطروحة على الساحة الاقتصادية والقانونية. وعليه تهدف هذه الدراسة إبراز الدور الفعال للوكالة في توجيه وتنظيم العقار الاقتصادي الموجه للاستثمار وبالنتيجة تأكيد على مركزية اتخاذ القرار في منح العقار الاقتصادي الذي اصبح يتم على المستوى الوطني بموجب قرار صادر عن الوكالة. The Algerian Agency for Investment Promotion is one of the effective institutions established to achieve economic development through the supervision of various investments in the country; this has led the Algerian legislator to reconsider its powers by enacting Law 17/23. Since the estate is the essential link for investment, the legislator has established bodies designed to regulate the exploitation of real estate designed for investment by determining how they work as well as their powers. This has been in keeping with the economic orientations aimed at improving the exploitation of this type of estate, which are considered one of the most important concerns in the economic and legal arena. Accordingly, this study endeavors to elucidate the pivotal role undertaken by the Agency in directing and regulating of Industrial estate designated for investment purposes, thereby reinforcing the centralization of decision-making authority pertaining to the allocation of such estate, which is exclusively conferred at the national level pursuant to a formal resolution promulgated by the Agency.
