عقد الزواج في ظل جراحة التجميل: بين الانعقاد والاستمرارية-دراسة على ضوء قانون الأسرة الجزائري

الملخص
استهدفت هذه الورقة البحثية دراسة جريئة وجادة حول أثر جراحة التجميل على انعقاد الزواج واستمراريته، وأظهرت بأن تطور جراحة التجميل وإقبال الأزواج عليها في العالم المعاصر، أصبح يشكل سبباً من الأسباب المؤدية إلى توجيه إرادتهم في اختيار شركاؤهم، فضلاً عن كونه يمثل عاملاً مؤثرا على صحة انعقاد عقد الزواج واستمراريته، مما يؤدي إلى ظهور العديد من المشكلات التي تهدد العلاقة الأسرية والمجتمع. لذلك، توصي الدراسة بضرورة إلزام الأزواج بتقديم الشهادات الطبية اللازمة لكشف التعديلات الجراحية قبل إبرام عقد الزواج، فضلاً عن إيجاد تنظيم تشريعي واضح واجتهاد قضائي مستقر ينظمان جميع المسائل المتعلقة بعيوب الرضا في إطار عقد الزواج. This research paper undertakes a bold and rigorous study on impact of cosmetic surgery on the formation and continuity of marriage. It found that the advancement of cosmetic surgery, along with the increasing tendency of spouses to undergo such procedures in contemporary society, has become a factor influencing their will in choosing partners. Moreover, it constitutes a significant element affecting both the validity of the marriage contract and its continuity, leading to the emergence of various issues that threaten family stability and society as a whole. Accordingly, the study recommends the necessity of obligating spouses to provide the required medical certificates disclosing any surgical modifications prior to the conclusion of the marriage contract, in addition to establishing a clear legislative framework and consistent judicial jurisprudence to regulate all matters related to defects of consent within the context of marriage.
