سلطة النص الشرعي وتحديات القراءة الحداثية- صحيح البخاري نموذجًا-

الملخص
ملخص: نتناول في هذا المقال إمكانية تطبيق مفهوم النص المفتوح (كما صاغه إيكو وبارت) على صحيح الإمام البخاري، من خلال تحليل مقارن بين منهج التأصيل الشرعي (الذي يركز على ثبات الدلالة والضوابط الشرعية) والمنهج الحداثي (الذي يؤكد على مرونة النص وتاريخانيته)، اعتمد المقال منهجيةً تكامليةً تجمع بين الأدوات السيميائية والتفكيكية من جهة، والأصول المقاصدية للشريعة من جهة أخرى، مع تحليل نماذج تطبيقية لأحاديث العقوبات والجهاد والأخلاق. توصل البحث إلى أن تجديد الخطاب الإسلامي يتطلب توازنًا دقيقًا بين انفتاح النص على التأويلات المعاصرة وضرورة الحفاظ على الثوابت الشرعية، مع اقتراح آليات عملية لتحقيق هذا التوازن، مثل تعزيز الحوار بين التيارات وتطوير مناهج تفسيرية وسيطة. Abstract: This study examines the applicability of the "open text" concept (from Eco and Barthes) to Sahih al-Bukhari by comparing two interpretive paradigms: classical jurisprudence, which emphasizes textual stability and Sharī'ah frameworks, and modernist approaches, which prioritize textual fluidity and historical context. Using an interdisciplinary framework, it integrates semiotic and deconstructive methods with the principles of maqāṣid al-Sharī'ah (the higher objectives of Islamic law). This approach is applied to three hadith clusters: penal codes, jihad doctrines, and ethical teachings. The findings reveal that renewing Islamic discourse requires a balanced equilibrium between contemporary hermeneutical possibilities and fidelity to normative legal principles. Proposed implementation mechanisms include (1) creating structured dialogue platforms between traditional scholars and modernist thinkers, and (2) developing hybrid interpretive models that incorporate traditional methodologies while addressing modern epistemological challenges.
