Abstract : This study examines the issue of deputizing another person to perform Ṣalāt al-Istikhārah from a comparative juristic and uṣūlī perspective. It clarifies the concept of istikhārah, its legal ruling, and the extent to which representation in it may be deemed legitimate, while analyzing the opinions of the jurists, the evidentiary bases of each view, and relating the matter to the governing principles in the law of worship—especially the maxim that “the default rule in acts of worship is tawqīf (restriction to revealed prescription),” and the question of whether purely physical acts of worship admit deputization. The study concludes that Ṣalāt al-Istikhārah is a purely bodily act of worship in which deputization is not valid in its original performance; thus, no one may perform the prayer of istikhārah on behalf of another, nor may one seek istikhārah in its legislated sense by proxy for someone else. However, it is permissible for another person to supplicate for the one seeking guidance, to offer counsel, and to assist him or her in reflection and consultation. It is also permissible, according to some scholars and with further detail, for one who is unable to perform the prayer to seek istikhārah through supplication without the prayer. The study affirms that this preferred view is consistent with the scriptural texts, the principles of legal theory, and the objectives of istikhārah, which are founded upon the servant’s direct entrustment of his or her affair to God.
