Abstract

In light of the increasing international need to protect human rights and fundamental freedoms, it became imperative for the international community to devise a mechanism for the protection of these rights and freedoms, and to establish deterrent legal mechanisms against reckless actions that could escalate to genocide without accountability or oversight. From this premise, the International Criminal Court (ICC) was established as a mechanism intended to safeguard humanity, protect the common human heritage, and preserve the acquired rights of humankind. This Court, possessing universal jurisdiction that disregards ranks and positions, was adopted at the United Nations Diplomatic Conference of Plenipotentiaries in 1998. Furthermore, it is a complementary court, meaning it does not investigate or rule on cases that have been conclusively dealt with by national judiciaries.
