مقاربة نظرية لفهم عقد الاحتراف الرياضي

الملخص
تستمد دراسة عقد الاحتراف الرياضي أهميتها البالغة من التحول الجوهري الذي شهده القطاع الرياضي، بانتقاله من كونه نشاطًا ترفيهيًّا أو هاويا، ليصبح صناعة احترافية تخضع لتنظيم قانوني، وقد أفرز هذا التطور إشكالية محورية تتمثل في صعوبة التكييف القانوني لهذا العقد، مما يقتضي معالجة نظرية معمّقة تهدف إلى تحديد طبيعته القانونية وتأصيل موقعه ضمن التصنيفات التقليدية للعقود. ولتحقيق هذه الغاية، توظّف هذه الدراسة المنهج الوصفي التحليلي، نظرًا لقدرته على تفكيك المفاهيم وتفسير الإشكالات النظرية، حيث ينصب التركيز على التأصيل التاريخي للاحتراف الرياضي، وتحديد ماهيته الاصطلاحية، وتمييزه عن الأنظمة القانونية المشابهة، كما تتناول الدراسة بالتحليل النقدي مختلف الاتجاهات الفقهية التي حاولت تحديد طبيعة العقد، مع مناقشة أسسها ومنطلقاتها، وذلك ضمن إطار نظري استقرائي يقتصر على الوصف والتحليل دون الخوض في الأبعاد التطبيقية أو الميدانية. The study of the professional sports contract derives its profound importance from the fundamental transformation witnessed in the sports sector, as it has transitioned from a recreational or amateur activity to a professional industry subject to legal regulation. This evolution has given rise to a pivotal problematic concerning the difficulty of the legal characterization of this contract, which necessitates an in-depth theoretical treatment aimed at defining its legal nature and establishing its position within the traditional classifications of contracts. To achieve this end, this study employs a descriptive-analytical methodology, owing to its capacity for deconstructing concepts and elucidating theoretical problematics. The focus is placed on the historical foundation of professional sports, the definition of its specific terminology, and its differentiation from similar legal regimes. The study also critically analyzes the various jurisprudential trends that have attempted to determine the nature of the contract, discussing their foundations and premises. This is undertaken within an inductive theoretical framework restricted to description and analysis, without delving into applied or field dimensions
